General probate rules deleted — state law controls. Yolo County's Chapter 6, which formerly contained Rule 25 (General Probate), has been entirely deleted. The court relies on the California Probate Code and California Rules of Court for all general probate matters. This means there are no local filing deadlines, probate note procedures, or extra document requirements beyond statewide defaults — but strict compliance with state law is essential since there is no local guidance to supplement it.

Guardianship hearings set 60 days out for investigation. While general probate rules are minimal, Yolo County maintains detailed guardianship rules under Chapter 7, Rule 26. Under Rule 26.1(d), the Clerk's Office sets guardianship hearings approximately 60 days after filing to allow time for the Court Investigator's report. For non-relative guardianships, notice must be mailed at least 45 days before the hearing to both the State Department of Social Services and the Yolo County Department of Employment and Social Services per Rule 26.1(f).

Due diligence declarations specify required search methods. Per Rule 26.1(g), where a petitioner cannot determine the name or address of a relative or party entitled to notice, a declaration of due diligence is required. The rule specifies that the declaration must detail searches of the telephone directory, directory assistance, contact with relatives and friends, inquiries with former employers, and verification at the last known address. Simply stating that a relative "could not be located" is insufficient.

Probate Investigator involved in guardianship oversight. Under Rule 26.5, the Probate Investigator conducts investigations on all petitions to establish a guardianship where the proposed guardian is a relative. For non-relative guardians, Child Protective Services conducts the investigation, and any delays in that process may cause continuances. Once a guardianship is established, the Probate Investigator assists the court in ongoing reviews of both person and estate guardianships, and must be provided with copies of all petitions to terminate a guardianship per Rule 26.5(d).

Investigation fees assessed at filing. Per Rule 26.5(e), a fee for the Probate Investigator's report is assessed and payable at the time of filing a petition for guardianship by a relative, pursuant to Probate Code sections 1513.1 and 1851.5. If the guardian or person liable for payment believes the fee should be deferred or waived due to hardship, the petition itself must include a request for deferral with supporting facts. Failure to pay does not delay approval but will result in referral to collections.
